Terms of Service

.  I. CONDUCT  .
- All parties are expected to write in a clear, concise and polite manner.
- All relevant reference material and requirements should be provided before any work begins or payment is submitted.
- Clear communication is required for accurate interpretation of your request.
- Failure to abide by the terms outlined may result in the commission being declined or canceled..  II. PAYMENT  .
- Commissions must be paid upfront or as per the payment plan.
- Payment accepted in USD only.
- Payment will be requested only via Paypal or Ko-Fi.
- Commissions will not be started until they are paid for.
- Payment plans are avalible for works exceeding $100.
- If the Client fails to pay the remaining balance within 30 days after final approval, the Artist reserves the right to withhold final delivery until resolved..  III. PROCESS   .
- Upon starting, commissions are generally expected to take between one week to one month to complete, depending on complexity.
- Client will be asked to approve the sketch, line art, and final stages of the artwork.
- If there are any circumstances that will affect commission completion, the client will be informed..  IV. REVISIONS   .
- The subject of the commission cannot be changed after payment has been submitted.
- A maximum of three revisions are given during the sketch and lineart stage free of charge. Further revisions will result in fees proportional to the additional workload.
- No revisions will be made once the commission is considered complete.

.  V. CANCELLATION + REFUND POLICY  .
- The artist has the right to cancel the commission and refund the appropriate amount at any time.
- Once the Client has approved a sketch, no full refund is allowed. In the event the Client requests a refund after the sketch has been approved, the refund will becapped at 50% of the total commission fee.
- If the Client requests a refund before any work is started, a full refund minus the deposit will be granted.
- In the event of a refund, the commission may not be transferred to another party.
- If the client ceases contact for over 30 days, the commission will be considered concluded and no refunds will be issued.
- Forcing a chargeback will result in blacklisting. All rights that may have been bestowed in relation to the artwork will be retracted and appropriate legal action may be taken..  VI. COPYRIGHT & USAGE  .
- The Artist retains full copyright over the commissioned artwork,
including the right to display and promote the work unless explicitly agreed otherwise in writing.
- Upon full payment, the Client is granted a perpetual, non-exclusive, non-transferable license to use the commissioned artwork for personal, non-commercial purposes only, including display on social media and personal usage.
- Under no circumstances may the artist's signature be removed from any work.
- Art may not be modified or edited by anyone but the original artist.
- Commercial use licenses can be provided for additional fees and negotiation.
- Under no circumstances may personal, non-commercial art be used for the purposes of making or promoting monetized content by anyone but the original artist.
- Under no circumstances may ANY art be used for Offensive, Hateful, NFT or AI purposes.

.  VII. ADOPTABLES  .
- Full ToS is in effect unless otherwise stated.
- The artist retains all legal rights. All adopts are for non-commercial use only unless otherwise negotiated.
- Holds are allowed for up to 48 hours.
- There is a seven-day cooldown following the date of purchase before the design can be transferred to a new owner.
- The Client is allowed to redesign my design as long as it does not include any form of inappropriate, offensive, or hateful content.
- Design is allowed to be used in any species. Please refer to that group's ToS for using pre-existing designs.
- The Client must keep the original design in the gallery and credit appropriately.
- Designs received for free (i.e. trade, gift, or raffle) can not be sold for any monetary value.
- Designs received for free can be traded, regifted, or re-raffled following seven days of receiving it.
- Design must not be sold for a higher value unless additional assets are included.

.  VIII. CUSTOMS  .
- Full ToS is in effect unless otherwise stated.
- Referential material is required (i.e. Pinterest boards, poses, and color pallettes).
- The Client can request:
A maximum of three revisions during the sketch stage.
A maximum of two adjustments after lineart is finished.
A maximum of two small corrections upon completion.
- Further corrections will cost an additional fee proportional to the workload.
- Client may use the design for roleplay and personal usage. Commercial use licenses can be provided for additional fees and negotiation.
-Usage in inappropriate, offensive, or hateful situations is forbidden.
- Original artwork can not be removed or edited over.
- Design can be resold, gifted, or traded.
- Design must not be sold for a higher value unless additional assets are included.
- (If Applicable) Species slots and/or trait items are not included.
